Dive safety — read this first

PickADive provides information for trip planning only. Depths, entries, hazards, forecasts, and “dive window” estimates combine model forecasts, public data sources, and community reports, and they may be incomplete, outdated, or wrong. Always verify conditions on site, dive within your training and experience, and make the final decision yourself.

Diving is an inherently dangerous activity that can result in serious injury, decompression illness, drowning, or death. Risks include, without limitation, currents, surge, surf, visibility loss, entanglement, marine life, boat traffic, equipment failure, and rapid changes in weather and sea state. By using PickADive you knowingly and voluntarily assume all such risks. To the maximum extent permitted by law, you release, waive, and discharge PickADive, its owner, and its contributors from any and all claims, demands, and causes of action of any kind — including claims arising from our own negligence — for injury, death, or property damage arising out of or relating to your use of the Service or your diving activities. This release does not apply to gross negligence, willful misconduct, or fraud, or to any liability that cannot be released under applicable law.

PickADive is not an emergency service. It cannot summon help, and we do not monitor it for distress. In an emergency contact local emergency services, the Coast Guard, or DAN Emergency (+1-919-684-9111).

Nothing on PickADive is medical advice. Forecasts and condition grades describe the environment only — they know nothing about your health, medical fitness to dive, certification, or recency. Questions about fitness to dive belong with a physician trained in dive medicine (see Divers Alert Network, dan.org).

PickADive forecasts never replace official warnings from national weather, marine, or emergency authorities. If an official warning conflicts with anything shown here, follow the official warning.

What these terms cover

These terms apply to the PickADive website, mobile apps, notifications, embeddable widgets, and all related services (together, the “Service”). By using the Service you agree to these terms.

For the iOS app: these terms are between you and PickADive, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any product claims; Apple and its subsidiaries are third-party beneficiaries of these terms with the right to enforce them. Apple is not responsible for investigating, defending, settling, or discharging any claim that the app infringes a third party’s intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Free to use, and changes to the Service

PickADive is free to use today, and core browsing, searching, saving, and contributing are intended to stay free. We built this for the dive community. We may add optional paid features in the future; if we do, we will say so clearly before you are ever charged, and anything you can do free today will not silently become paid. We may modify, suspend, or discontinue any part of the Service at any time, and we do not promise any level of availability, uptime, or continued support for any feature.

No warranty

THE SERVICE AND ALL CONTENT — INCLUDING FORECASTS, CONDITION GRADES, DIVE WINDOWS, TIDES, DEPTHS, SITE DETAILS, MARINE LIFE AND SPECIES INFORMATION, AND COMMUNITY REPORTS — ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. YOU ARE SOLELY RESPONSIBLE FOR CONFIRMING THE ACCURACY OF ALL INFORMATION BEFORE RELYING ON IT.

Alert notifications are best-effort and may be delayed or not delivered — never rely on an alert as your only check.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKADIVE AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, AND OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE PAST TWELVE MONTHS OR USD $100. Some jurisdictions do not allow certain exclusions or limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law.

Automated access and bulk extraction

Search-engine and AI-assistant crawling of public pages is welcome. What is not permitted without prior written consent: bulk extraction, scraping, or systematic harvesting of PickADive content; republishing substantial portions of our public pages; and use of our original descriptions or editorial content beyond fair use. Nothing in these terms grants rights to material owned by other parties.

Your contributions

Content you submit (reviews, conditions reports, photos, site edits, sightings) remains yours. By submitting, you grant PickADive a worldwide, royalty-free license to display, adapt, and distribute it as part of the service, with attribution to your profile. Submit only content you have the right to share, and report conditions honestly — other divers rely on it.

Copyright infringement claims (DMCA)

We respect the work of photographers and creators, and we respond to copyright notices under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on PickADive infringes your copyright, send a notice to our designated copyright agent at team@pickadive.com with “DMCA notice” in the subject line, including:

• identification of the copyrighted work you claim is infringed;
• the URL (or other location on PickADive) of the material you want removed;
• your name, mailing address, telephone number, and email;
• a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
• a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for them; and
• your physical or electronic signature.

We remove or disable access to material identified in valid notices promptly. Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f), so please be sure before you send one.

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notification to the same address including the removed material’s prior location, a statement under penalty of perjury of your good-faith belief that removal was a mistake, your contact details, consent to the jurisdiction of the federal courts, and your signature. We will follow the process § 512(g) sets out, which can include restoring the material.

Repeat infringers: in appropriate circumstances, PickADive terminates the accounts of users who repeatedly infringe copyright.

Accounts and conduct

You must be at least 13 years old (or the minimum age required in your country) to create an account. Do not misuse the service: no false reports, impersonation, harassment, attempts to disrupt the service, or circumvention of technical protections. We may remove content or accounts that break these terms.

Indemnification

You agree to indemnify and hold harmless PickADive from claims, damages, and reasonable legal fees arising from your use of the Service, content you submit (including conditions reports), your violation of these terms or any law, or your violation of another party’s rights.

Disputes

To the extent permitted by law, you and PickADive each waive any right to a jury trial and agree that claims may be brought only in an individual capacity — not as a plaintiff or class member in any class or representative action.

Changes and contact

We may update these terms; material changes will be dated on this page and, for account holders, announced in the product or by email. If any provision of these terms is held unenforceable, the rest remain in effect, and the sections on dive safety, warranties, limitation of liability, indemnification, and disputes survive any termination of your account or these terms.
